1. Agreement to Terms
By downloading, installing, activating, or using CarSnipe software or services ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to every provision of these Terms, you must immediately stop using the Service and uninstall the software.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and CarSnipe ("we," "us," or "our"). Your continued use of the Service following any modifications to these Terms constitutes acceptance of the revised Terms.
2. Description of Service
CarSnipe is a desktop monitoring tool for Windows that uses browser automation to check Facebook Marketplace for vehicle listings matching criteria you specify. Matching results are delivered to you via Telegram. The Service consists of:
- A Windows desktop agent application ("Agent") that runs on your computer
- A Telegram bot ("Bot") used for configuration, alerts, and account management
- Backend infrastructure operated by us to bridge the Agent and Bot
3. Third-Party Platform Dependency — Critical Disclosure
PLEASE READ THIS SECTION CAREFULLY. CarSnipe's core functionality depends entirely on continued access to Facebook Marketplace, a platform owned and operated by Meta Platforms, Inc. ("Meta"). CarSnipe is an independent, third-party tool and is not affiliated with, endorsed by, authorized by, or sponsored by Meta Platforms, Inc. or Facebook in any way.
3.1 Platform Change Risk
Meta may, at any time and without notice to CarSnipe or to you:
- Change the structure, layout, or technical interface of Facebook Marketplace
- Implement technical measures that block or restrict automated access to Marketplace
- Modify, restrict, or discontinue Facebook Marketplace entirely
- Enforce their Terms of Service in ways that affect the operation of CarSnipe
- Limit access based on geographic region, account type, or other factors
Any of these events may cause CarSnipe to function partially, intermittently, or not at all, either temporarily or permanently. You expressly acknowledge and accept this risk as a condition of using the Service.
3.2 Our Commitment to Compatibility
We will make commercially reasonable efforts to update the CarSnipe Agent to maintain compatibility with Facebook Marketplace following significant platform changes. However:
- We cannot guarantee that updates will be released within any specific timeframe
- We cannot guarantee that technical workarounds will always be possible
- Some platform changes may make certain features permanently unavailable
- In extreme cases, a platform change may make the Service entirely non-functional
Service interruptions caused by Facebook/Meta platform changes do not automatically entitle you to a refund beyond what is specified in our refund policy. By subscribing to CarSnipe, you accept this inherent risk of using a service that relies on a third-party platform.
3.3 Facebook Terms of Service Compliance
You are solely responsible for your own compliance with Facebook's Terms of Service and Community Standards. We do not represent that use of CarSnipe is permitted under Facebook's Terms of Service. You accept full responsibility for any consequences to your Facebook account, including but not limited to account restrictions or bans, resulting from your use of CarSnipe.
4. License Grant
Subject to your compliance with these Terms and timely payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to:
- Install and use one instance of the Agent on a single personal computer
- Use the Telegram Bot for personal, non-commercial vehicle search purposes
- Receive software updates delivered during your active subscription period
This license is for personal use only. All rights not expressly granted are reserved by CarSnipe.
5. Restrictions
You agree NOT to:
- Redistribute, resell, lease, sublicense, or otherwise transfer the Service or your account
- Reverse engineer, decompile, disassemble, or attempt to derive source code from the Agent
- Use the Service for commercial dealership operations, vehicle flipping businesses, or bulk acquisition
- Share your license key, account credentials, or Telegram session with any third party
- Use the Service to send unsolicited messages, spam, or harass Facebook Marketplace sellers
- Use the Service for any automated purchasing, bidding, or resale operation
- Attempt to circumvent license restrictions, usage limits, or security measures
- Use the Service in violation of any applicable law or regulation
- Run more than one Agent instance per license
6. Subscription, Billing & Payment
6.1 Subscription Plans
CarSnipe is offered on a subscription basis. Available plans and pricing are listed at carsnipe.com/#pricing. Pricing may change with 30 days' notice to active subscribers.
6.2 Payment Processing
Payment is processed securely through Stripe. We do not store your credit card or payment details on our servers. By completing a purchase, you also agree to Stripe's Services Agreement and Privacy Policy.
6.3 Free Trial
New users may receive a 7-day free trial with full Pro-level access. A valid payment method is required to start the trial. Unless you cancel before the trial ends, your trial automatically converts to a paid subscription for the plan you selected, and your payment method is charged at the then-current rate. We send a reminder before billing begins, and you can cancel at any time using the /billing command in the Telegram Bot — if you cancel before the trial ends, you will not be charged. Free trials are limited to one per person/Telegram account. We reserve the right to modify or discontinue the free trial offer at any time.
6.4 Renewal and Cancellation
Subscriptions renew automatically at the end of each billing period. You may cancel at any time using the /billing command in the Telegram Bot, which provides access to the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time except as described in Section 6.5.
6.5 Refund Policy
We offer a 7-day money-back guarantee on first-time paid subscriptions. If you are not satisfied within 7 days of your first charge (following a free trial), contact us at [email protected] for a full refund. After 7 days, refunds are at our sole discretion. Refunds are not provided for service interruptions caused by Facebook/Meta platform changes.
7. Software Updates
We may release Agent updates to fix bugs, improve performance, address security issues, or restore compatibility with Facebook Marketplace changes. Updates may be required for continued operation. By using the Service you consent to the Agent automatically checking for and downloading updates. You remain responsible for installing updates promptly.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR CONTINUOUSLY AVAILABLE
- ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ALERTS OR LISTING DATA
- ANY WARRANTY THAT THE SERVICE WILL BE COMPATIBLE WITH FUTURE VERSIONS OF FACEBOOK OR WINDOWS
- ANY WARRANTY THAT THE SERVICE WILL DETECT ALL LISTINGS MATCHING YOUR CRITERIA
- ANY WARRANTY AGAINST DISRUPTION CAUSED BY THIRD-PARTY PLATFORM CHANGES
We do not warrant that CarSnipe will help you successfully purchase any vehicle, or that any alert delivered will result in a vehicle being available at the time you respond.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CARSNIPE, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
- MISSED VEHICLE PURCHASES, PRICE DIFFERENCES, OR LOST DEALS
- ALERT FAILURES, DELAYED ALERTS, OR MISSED LISTINGS
- SERVICE INTERRUPTIONS CAUSED BY FACEBOOK/META PLATFORM CHANGES
- ANY CONSEQUENCES TO YOUR FACEBOOK ACCOUNT ARISING FROM USE OF THE SERVICE
- ANY DAMAGES ARISING FROM YOUR RELIANCE ON THE SERVICE FOR ANY PURCHASING DECISIONS
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
Some jurisdictions do not allow exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless CarSnipe and its owners, operators, employees, and agents from any claim, demand, damage, cost, or liability (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including Facebook's Terms of Service; or (d) any actions taken by Facebook/Meta with respect to your account as a result of your use of CarSnipe.
11. Account Termination
We reserve the right to suspend or terminate your license and access to the Service, with or without notice, if you: violate these Terms; engage in fraudulent, abusive, or illegal behavior; attempt to circumvent license restrictions or security measures; or use the Service in a way that harms other users or our platform.
Upon termination, your license to use the Agent is revoked and you must uninstall the software. Termination for cause does not entitle you to a refund.
12. Intellectual Property
CarSnipe, its logo, software, and all related content are the intellectual property of CarSnipe and are protected by applicable copyright, trademark, and other laws. You may not use our name, logo, or branding without our prior written consent.
13. Changes to Terms
We may update these Terms at any time. We will provide notice of material changes via the Telegram Bot or by posting a notice on our website. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.
15. Severability
If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
